1. Agreement to these terms

By accessing this website, you agree to these Terms of Service. If you do not agree, do not use the website. You must be legally able to accept these terms where you live. The site is not directed to children under 13.

2. What Degen David provides

Degen David is a fictional illustrated entertainment project. It presents comedic diary-style stories about an adult character's chaotic life, including crypto culture, attention difficulties, alcohol, gambling impulses, and everyday mishaps.

The operator also uses a private companion desktop workflow to prepare illustrated videos and publish them to authorized social-media accounts. This public website is informational: it does not provide public user accounts, uploads, payments, trading, gambling, or financial services.

3. Entertainment only — not advice

All characters, stories, jokes, charts, trades, wins, losses, and scenarios are fictionalized or presented for comedy. Nothing on the site or in Degen David content is financial, investment, tax, legal, medical, mental-health, addiction, or gambling advice.

You are solely responsible for your own financial and personal decisions. Crypto assets and gambling can involve significant risk, including complete loss. Do not treat David's choices as instructions, signals, endorsements, or evidence of expected results.

4. Acceptable use and responsibilities

You may browse and link to public pages for lawful personal use. You may not:

• interfere with the site, hosting infrastructure, or access controls;
• use automated requests in a way that creates an unreasonable load;
• misrepresent Degen David content as professional advice or guaranteed results;
• copy, sell, impersonate, or falsely claim ownership of the character or original content;
• use the site or content to violate another person's rights or applicable law.

5. TikTok and other third-party platforms

Degen David may publish through services such as TikTok, YouTube, GitHub, or Vercel. Those services are operated by third parties and apply their own terms, privacy policies, availability rules, moderation, and technical limits.

Degen David is not affiliated with, sponsored by, or endorsed by TikTok. TikTok names, interfaces, and services belong to TikTok and its respective owners. Authorization to publish to an account does not create a partnership or endorsement.

The operator is not responsible for third-party outages, account actions, API changes, content removals, or the accuracy of third-party material. A link does not imply endorsement.

6. Intellectual property

The Degen David name, recurring character, original illustrations, writing, layout, and other original project materials are owned by the operator or used with permission. These terms grant you no ownership interest.

You may share links and use ordinary platform sharing tools. Any broader reproduction, redistribution, commercial use, character merchandising, or creation of a confusingly similar identity requires prior permission. Third-party marks remain the property of their respective owners.

7. Availability, disclaimers, and limitation of liability

The website and content are provided “as is” and “as available.” To the fullest extent permitted by applicable law, the operator disclaims implied warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability.

To the fullest extent permitted by applicable law, the operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, trading losses, gambling losses, or decisions made in reliance on the site or content.
